General terms and conditions of sale

Introduction

All the products commercialized by www.erbedimauro.it are subject to these terms and conditions of sale (hereinafter "General Conditions"). All the purchase agreements, made through the website www.erbedimauro.it, and according to the procedures indicated therein, between the seller and the customer, are subject to these General Conditions. All the prices published on the website are inclusive of VAT.

Acknowledgment of terms and conditions of sale

The contract stipulated between the Erbe di Mauro Srl and the Customer must be considered concluded with the reception, even if only partial, of the order by Erbe di Mauro Srl, that reserves the right, at its sole discretion, to accept the order. Acceptance is considered implicit, unless otherwise communicated in any manner to the Customer. By making a purchase order, in any of the various methods, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general terms and conditions of payment as transcribed below.

If the Customer is the end user (ie a person who buys the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy of it and, in any case, keep the present general term and conditions of sale, in compliance with the provisions of Articles 3 and 4 of the Legislative Decree n. 185/1999 on distance sales.

Any right of the Customer to compensation for damages or reimbursement is excluded, as well as any contractual or extra-contractual responsibility for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order.

Purchase method

The Customer can only purchase the products displayed in the electronic catalog of the website www.erbedimauro.it at the time of placing the order, as described in the relevant information sheets. Be advised that the image accompanying the descriptive card of a product may not be perfectly representative of its features and may slightly differ in color and size. All the purchase support information is meant to provide easy and general information to the Customer.

The correct receipt of the order is confirmed by Erbe di Mauro Srl through a reply via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will include Date and Order Number, to be used in any further communication with Erbe di Mauro Srl. The message includes all the data entered by the Customer who is requested to verify its correctness and to promptly communicate any corrections to be made, according to the procedures described in this document. The Customer can also check the order status by accessing the dedicated web area under the heading "my account".

The Customer can request the cancellation of the order until the product has not arrived yet in the stock for preparation to shipment. The order status is clearly visible in the "Order Status" section of your Personal Area. The order can no longer be canceled if the order status is "Order in process".

All prices displayed on the website are prices for the public and, therefore, inclusive of VAT. Erbe di Mauro Srl reserves the right to change prices at any time, without notice. If an incorrect and / or clearly derisory price is displayed, for any motivation (error in our systems, human error, etc.), the order will be canceled, even in case of initial validation.

The website www.erbedimauro.it does not show the available quantity of products at the time of ordering. Given the simultaneous access of many users-customers and the simultaneous possibility of "online" orders, the availability of the product may change, Erbe di Mauro Srl does not guarantee the certainty of allocation of the ordered goods.

Payment methods

• Cash on delivery
  We accept the cash on delivery payment method only for a purchase that is equal to or higher than € 34.00 VAT included, it is available only for shipments in Italy and San Marino. The Cash on delivery is not available for shipments abroad. For the payment through cash and delivery it is applied an extra fee € 7,90 to the total amount of the order, clearly shown at the time of the choice of payment method. The payment must be in cash only, giving to the courier the exact sum. For logistical reasons, cash on delivery is not valid for the purchase of Aloe plants. Cash on delivery is only available in the periods between 01 September and 31 May. We do not accept this payment method in the summer period from 1 June to 31 August.
• Bank Transfer
  In case of purchase through bank transfer, the shipment of the goods will take place only upon the actual credit entry on the account of Erbe di Mauro Srl, or after receiving the payment slip, showing the code CRO, to the following e-mail address: order@erbedimauro.it Following is the data for the bank transfer:

• PayPal
  In case of purchase through the PayPal, completing the order the Customer is directed to the PayPal login page. The order amount is charged to your PayPal account at the time the order is purchased.
  In case of cancellation of the order, both by the Customer and in case of non-acceptance by Erbe di Mauro Srl, the amount will be refunded to the customer's PayPal account.
  The cancellation of the order is possible until the moment the goods have not arrived yet in the stock. The order status is clearly visible in the "my account" area and can no longer be canceled if the indication "Order in process" appears.
  Once a Customer requests the cancellation of the transaction, the Erbe di Mauro Srl under no circumstances can be held responsible for any damages, direct or indirect, caused by delay or the failure to release the amount committed by PayPal. Erbe di Mauro Srl is not able to know the customer's financial information at any time during the purchase procedure. Since there is no data transmission, there is no possibility that the data is intercepted. No computer archive of the Mauro Vallesi farm contains or retains such data. For each transaction made with the PayPal account, the Customer will receive an e-mail confirmation from PayPal.
• Postepay recharge
  Recharging the Postepay is very convenient and can be done in many ways. For example, in cash by going to a post office, at a betting office, or any tobacconist (if these methods are possible in your town). If you also have a Postepay card, you can also recharge online, from the website, or using the Postepay comfort app, which you can download for free on any smartphone. Once you have paid through Postepay, send an e-mail to order@erbedimauro.it, indicating the date and time of the payment. We will then send the goods.
• Unpaid orders
  Unpaid orders will be automatically canceled after 20 days from the order date.

Security of Transactions

Online transactions with a credit card can only be made through Paypal, on the Paypal website, through a secure server that adopts the SSL (Secure Socket Layer) protection system. This protocol, certified by Verisign, allows for a communication mode designed to avoid the interception, modification or falsification of information. Erbe di Mauro Srl does not get to know the credit card data used by its customers.

Shipping and Delivery of Products

To ensure the utmost freshness of the product, the shipping of the ordered items takes place on Mondays, Tuesdays and Wednesdays and normally the delivery time is 24-48 hours (Saturdays and holidays excluded) from the time the order is purchased. If this is not possible, for example due to products that are temporarily out of stock, or if your data are incomplete, you will be notified by e-mail or phone call. The packaging and shipping are carried out with the utmost care and attention, but if something does not satisfy you, please let us know.

Shipments in Italy and San Marino

The cost of shipping in Italy and the Republic of San Marino is € 7.90 including VAT, for orders of less than € 36.00 including VAT, while they are free of charge for orders equal to or above € 36.00 including VAT.

For payments made through cash on delivery the shipping cost is € 7.90 including VAT and is available only for shipments in Italy and San Marino.

Shipments Abroad

We ship to selected European countries (see the table below). The conditions above are valid for Italy and San Marino: for shipments to other countries, there may be variations in delivery times and shipping costs, which are calculated based on the weight of the products ordered and shown in the online form before submitting the order.

• Delivery time: 48/72/96 hours, depending on the destination country, the service is fast and trackable.
• Shipping days: we ship every Monday and Tuesday to speed up the delivery.

The above countries are completely free of customs fees, taxes, etc. so the price is all-inclusive.

Termination right

Pursuant to Legislative Decree 206/2005 (Consumer Code), you have the right to terminate the contract without penalty and without specifying the reason within 14 working days from the day you receive the products. To exercise the right of termination you must inform us about your decision with an explicit declaration, for example by e-mail or regular mail, within the expiration time of the withdrawal period. To do so, you can use the termination form, yet it is not mandatory.

You must then return the intact products, in the original packaging, within 14 days from the communication of your wish to terminate the contract, to the following address: Erbe di Mauro - C.da San Girolamo 123 - 63900 Fermo (FM)

The return of the products is at your charge and under your responsibility. Do not send back the goods through the delivery on cash method, as they will not be accepted. As soon as we receive the products we will reimburse the sums paid in our favor, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery more expensive than the type offered by us) within 14 days, with the same means of payment that you use, unless otherwise agreed, and with no charge to you.

If the products ordered are not picked up and return to the sender, you will still be required to pay the shipping costs incurred by us for the return of the package. Perishable or tailor-made products (such as herbal teas, Aloe leaves and Aloe juices), open or partially used products are excluded from the termination right. You will be liable for any diminished value of the goods resulting from a handling other than that indispensable to maintain the products’ nature, features and functioning.

Complaints

Any complaint must be addressed to Erbe di Mauro Srl, Contrada San Girolamo, 123 - 63900 Fermo (FM) .

Warranty

All products purchased have a warranty of 24 months for any flaw that prevents their correct use, in this case we will replace them at our own expenses. For products with an expiry date of less than 24 months, the warranty will be applicable until the expiration date. For any problems related to the transportation of products, the customer is required to verify the integrity of the package and its contents and to report any anomaly within 48 hours from the receipt.

Jurisdiction and governing law

The sales contract between the Customer and the Erbe di Mauro Srl is stipulated in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the stipulation of this contract of distance selling, if the customer is an end user, the territorial jurisdiction is that of the reference forum of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Foro di Fermo.

Privacy protection

Personal data collected through this website will be processed in accordance with the Legislative Decree 196/2003 on the protection of privacy, and therefore will be used exclusively for the purposes indicated, kept confidential and communicated only to those responsible for delivering the products (post or courier) to the collection of payments and invoicing and in no other case will be transferred to third parties. The subject responsible for data archiving and processing is Erbe di Mauro Srl.

The data collected will be processed in paper form or through electronic tools for all the purposes necessary for the implementation of orders and for sending periodic information (Newsletter information) if already made an explicit request. In all these cases, the provision of data is optional, but the consent to the processing of data is essential for the performance of these operations.

Erbe di Mauro Srl adopts the appropriate security measures provided by the code for the personal data protection, aimed at ensuring the maximum security and confidentiality of processed personal data. To protect your privacy as much as possible, the products ordered on our website will arrive in a package containing only the generic word "Herbal Products", without detailed information on the content (excluding some types of shipments abroad, for which is requested the detailed indication of the contents to be written in the transportation document).
